Terms of Service

1.  Introduction:
   Please read all of the terms and conditioins below.
   We will terminate your account for breaking any of the terms listed below.
   BigFoot Hosting reserves the right to modify these terms and conditions at any time.
   
   

2.  Account usage:
   All accounts are to be used by the primary owner only. Account holders are not permitted to resell, store or give away web hosting services from their web site to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads. BigFoot Hosting reserves the right to refuse service and/or access to its servers to anyone.
   

3.  BigFoot Hosting does not allow the following contents:
   

   1. SPAM - Any site operators who uses/stores any kind of spamming software, or whose spamming activities affect BigFoot Hostings servers negatively in any way, will have their accounts terminated without warning. They will also be fined $100.
      

   2. Mailing lists - Including and not limited to mailman, Majordomo, PHPlist, ..etc. are not allowed to run from BigFoot Hosting servers disregarding the content of this lists messages or size, even with what so-called obtained addresses.
      
      

   3. MLM - Any mailing, posting or content of "Make Money Fast" (MMF) or "Fast Cash" or pyramid schemes or chain letters or MLM (multi level marketing) schemes of any sort will result in quick account termination.
      
      

   4. Illegal Material - This includes copy-righted works, commercial audio, video, or music files and any material in violation of any Federal, State or Local regulation.
      
      

   5. Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of BigFoot Hosting. Please contact first if you think that you may violate this term.
      
      

   6. Online Gaming - Includes all online/offline Casinos, Jumpling, MUDs, interactive gaming on our servers, Anime communities, PlayStation games Forums, news, reviews.
      
      

   7. IRC bots - Includes and not limited to Eggdrop, IRCD, PSY BNC, ...
      
      

   8. Hate material - We define hate material as that which expresses or promotes hatred against groups of people. For example, racist, anti-Semitic, material targeting a particular religion or homophobic material are considered to be hate material. We reserve the right to identify hate material for what it is (including identifiers on member sites).
      
      

   9. Warez - Includes pirated software, ROMS, emulators, freaking, hacking, password cracking or cheating, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
      
      

   10. Shell scripts - BigFoot Hosting does not provide shell access under any conditions, installing third party shell tools using CGI, PHP or any other method will met by instant termination of account. If you need something done that requires a shell account let us know. We can do it for you and possibly add a new tool to your control panel.
       
       

   11. Hot-Linking - You can not use your account to store files or scripts that serve files or services to another domain name, all files have to be linked to pages to your index page.
       
       

4.  Invalid or Non-Transfered Domains:
   Every account must have a properly registered domain name, which resides on our domain name servers, within 15 days of the account's opening. After 15 days, accounts without registered or transferred domain names will be terminated automatically. No warnings will be given, and any payments already made will be forfeited. No refunds will be given.
   
   

5.  Server usage:
   When a web site is found to be monopolizing the resources available, BigFoot Hosting reserves the right to suspend that site immediately. This policy is implemented only in extreme circumstances and is intended to prevent the misuse of our servers.
   As long as you do not violate any other terms in this page, you are able to host and destribute files with no limitation or restrictions within your plan limit.
   If a customer exceeds their bandwidth data transfer as stated in their plan, they will be charged $4.95 Per GB over their plan allotment.
   If we find that your site is consistently using 10% or more of the servers resources we may issue a warning or have its account deactivated. This is for the protection of our clients and maybe caused by an issue that you are unaware of.
   
   

6.  PRIVACY POLICY:
   We are committed to protect and respect the privacy or all our customers. The information collected from customers when signing up is used for billing and administration purposes only and will be kept confidential. Contact and billing information collected will NOT be passed onto ANY third parties except where required by law.
   
   

7.  CANCELLATION AND REFUNDS:
   BigFoot Hosting reserves the right to cancel the service at any time. A prorated refund may be made depending on the reason for cancelation. All payments to BigFoot Hosting are non-refundable. If you think you warant a refund please send a request to billing@bigfoothosting.com We reserves the right to refuse any refund request.
   
   

8.  LIMITATION OF LIABILITY:
   BigFoot Hosting shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from BigFoot Hosting servers going off-line or being unavailable for any reason whatsoever. Furthermore, BigFoot Hosting its representatives, heirs, assigns, and parent company shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of the BigFoot Hosting servers. All damages shall be limited to the immediate termination of service.
   
   

9.  DISCLAIMER:
   BigFoot Hosting cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by BigFoot Hosting are resold. Thus, certain equipment, routing, software, and programming used by BigFoot Hosting are not directly owned or written by BigFoot Hosting. Moreover, BigFoot Hosting holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as BigFoot Hosting sees fit.
